I am planning to send a letter to President, First Lady, DOS chief besides other Govt. rep. Anyone has the addresses?
I am in CP and I am writing to them to allow CP filers who are already working here in the US to file for AOS (even if the PD is not current) anticipating a very long delay for EB3 I. That way we could get atleast the minimal benefits like EAD, AP.
If any CP filers from EB3 I wanna join me, more than welcome!

This is my first message after so long time...
USCIS stoped issuing interim EAD before years... We just been to local office this Monday and they said they don't issue it any more..

Thought I'd offer an alternate view on the AC21 letters. I switched jobs after my I-485 had been pending 180 days, and my attorneys advised me to NOT send in an AC21 letter. They said, "Chances are, you will not get an RFE, and if you do, you can send in the AC21 letter at that time. If you do send in an AC21 letter, you will definitely get an RFE". These attorneys had always given me excellent advice in the past, so I have not submitted an AC21 letter.

Ask your lawyer, what happpens when previous employer revokes 140 petition. The answer will be, "As USCIS does not know that you ported off, they will send a NOID and we will respond to the NOID. If they send a denial by mistake, we will reopen your case using MTR"

My wife's H4 expires on Oct 1, 2007......We plan to file our I-485 by July 16, 2007.......I am sure it will take atleast 90 days to get her EAD.....whats her status between Oct1,2007 till the time EAD gets approved?......Will she be in valid status during that period?

Sorry to hear that your 485 is denied....
My question to all the gurus here...I wonder what happens to EAD and AP after you appeal 485 denial?
I know that if your 485 gets denied then EAD and AP are void but lets say OP files 485 MTR(motion to reopen), does he have to reapply for EAD and AP or does that get reinstated based on the reciept he gets on 485 MTR?
Should the person stop working till he gets 485 MTR receipt or till he reapplies for new EAD and gets the approval?
Just curoius to know as these days denials seems to be the trend at USCIS and it would be helpful for all those who rely on EAD only and not sure what to do when there is a 485 denials for what ever reason.
FYI...I am still maintaining my H1 and also have a EAD but plan to switch to EAD only and not renew my H1 this year.
You do NOT have to apply for another EAD. You're safe to go back to work as soon as you receive your MTR receipt. I am sure most people work even while they're waiting for the MTR to be received by uscis though but shhh. I have never heard of a case where the uscis wanted to make sure the person didn't work while they were waiting for their MTR receipt to be sent out. Can you imagine them doing that to someone after their own officer denied the case in error resulting in an individual having to pay 500 bucks to reopen the case? Slap after slap in the face.

Yes, Its the same number, but at one of the prompts, you need to put a different number for LIN.
I just call them, was told that they have no additional information that what is available on the recorded message or the USCIS case status web site. I said I wanted to know if the case is 'pre-adjudicated' and the lady mentioned that that information is not disclosed. ;(

What is I140 tracking number? How to get it?(I don't have any info about my i140 - only that it was approved and I have h1 extension petition of 3 yrs based on that.)
And did you request part info or full info therein? Your case is a light in tunnel- you got the info in about 3 months - right?

This is the same number I got from my employer for online tracking on USCIS website. It took over 4 months. I submitted this as soon as got approval on my I-140. If you dont have the tracking number, you may try to get your A# from employer or attorney. You can use the same reason that you are changing address or that you need it for visa stamping. I believe they ask for A# in visa interview form.
I have heard that few people got the tracking number using Infopass. Not sure how. I would suggest, that do not delay. Submit the FOIA form with whatever info you have. They might be able to pull your records based on the SSN# or I-94# etc. No harm in trying. I didnt had A#, so I left it blank.

as per the law u can switch employers after 180 days from recipt of ur 485 application...unless the CBP wants to give u a hard time...he should not jerk u around on that....

I beg to differ.. My PA DL is based on my Work Visa, hence it expires on the day my visa expires.. I tried to renew online and the system said since you are not a citizen u have to go to the DL Center for a renewal... Maybe your DL is from the time you were student or otherwise...
The best thing about PA is through online.
