thats the problem.... I cannot switch to another job as I am in the 7th year of H1B and I-140 approved but did not apply for I-485 yet. friends told me its risky to switch jobs now as I may be out of status.
Boss, I was exactly in same position as yours. You can call it a mirror image. I switched in 9th yr of h1 after being a white collar slave with same employer. I'll suggest before you loose self respect and confidence in your own eyes..... SWITCH.

I think the OP has some valid points. Certainly recapture lawsuit may work as the law does not say that allocated EB visas expire. Do not listen to nay-sayers, just do it.
Here is one example of the succsessfull class-action (even though the court case died in a court of appeals, it was beneficial to immigrants):

Is there any Specific date, I mean when AILF is filing the case...USCIS is announced they are gonna reject the applications..but did they rejected any single application?? We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.
Finally they dont reject application nor they will accept it...
Guys send flowers with all your comments on JULY 10TH...we may get media and political atten...

This bill has nothing related to EB applicants.
Also looks like Sec. 501 Earned Access to Legalization may apply only to illegals.
The more it is closer to amensty, it will not go forward.

true, my green card was filled EB 3 Software Engineer, today I am an architect, jumped 3 level up . I dont know why you can't get promoted.
You can still get promoted while on H1B just don't give up hope. If you're not getting promoted even if you're performing well, then there's something fishy going on with your employer.

Hi,
I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.
I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

People came all the way from CT and Long Island and Poughkeepise. We are working hard to gather people in various areas, you can see how people are dedicated and committed.
An entire family came from Hillside avenue and I dropped them in the night.
We will be doing more meetings in various places making sure there is enough majority and things workout
PLEASE FORGIVE US FOR YOUR INABILITY TO ATTEND.

There was no RFE at all . Infact I was following up my case through my congressman's office and we always got responce back from uscis saying it is under "Security review" .
The email says "application denied." if it says RFE , I would not have such a shock .
it was reall gard day for me y'day when I sow that . I was almost on the werge of closing a house deal this month and with this 485 issue , I don' think I want to take the risk of buying the house now.
Though I do have little bit hope if it is because 140 revoke and we can prove the AC21 documents , it will get through .

The OP does not look agitated enough and basically is just telling us "Vinod" used AC21 and got rejected. He is unwilling to give more details in his profile but telling us his name is Vinod.

There are favorable indications from the industry that they will get increased H1Bs. There is hence a strong belief among many lawyers that the H1B lobby will provide some relief. But we need to meet lawmakers so that they don't forget about the Green cards.
If you live in NY state, please contact bottlemani or myself. We need to organize ourselves before meeting the lawmakers. We will also have to take the trouble to drive to their offices. If we don't do this, all these pessimistic predictions will come true. Believe me, meeting the folks in the offices of the lawmakers makes a huge difference.

It is sad to see that only few people have signed up for state chapters. there are very few on your NY thread even though we have several members from NYC and NY state. We all need to change our attitude and help each other in this common cause. seems funny that we are suddenly discussing God in this topic. But Any of the arguments presented here definitely do not prove that God does not exist.
As for praying. If merely praying would result in me getting results why should I even pray to get a GC, I would rather just pray that I never have to work and get all the needs of this life fulfilled without any effort. Why do I even care about a GC. And everyone would have started doing that.
The idea is never that of praying but of faith. Believers can give you millions of cases when their faith resulted in a favorable result. Almost all religions alo say that the first step towards having faith is to perform your duties as well as you can. Without this, there is no point of praying. Coming to religions, most also have ways of redemption but there is no way to redeem for acts in the future as you are expected to do your best.
You may or may not have faith in God, but logically it is difficult to argue one way or the other. There is a reason why even the greatest of all philosophers have not been able to come to a conclusion.
To each his own.

Reading the article I see that Neelima is, in fact, a US citizen of indian origin; not even an H1-B or GC. So lesson for us - getting a GC may be a convenience for us, but we are naive to think our troubles will end with it.Red neckers of the likes of Loo and his cronies arent suddenly going to accept us as one of them - rather, this is a life long struggle of the kind the african americans had to go through for centuries (and to some extent are still going through). Only wish ABCDs like Ron Hira realize that as well.

OK. I received the Denial letter today and below is the extract from it.
What does not make sense to me is that it said I140 revoked but in the next line it said I 140 revoked because it you did not meet minimum requirments for labor cert .
This I140 was approve ( it was file for me ) and if they did have this question at that time , how come they revoke it now.
Or is this is the way they normally denay the 485 ?
I am in big trouble . ???

Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.
