My I-140 was denied incorrectly , as a result my I-485 was denied.
The USCIS is claiming that the I-140 Petition was filed without a certified PERM application. This is absolutely incorrect. The original certified PERM application was filed with the I-140 Petition. I have a photocopy of the original PERM application.
My lawyer filed MTR for both I140 and I485 6weeks ago.I received receipt notices for both I290B.
I was working on my H1B till last week, but was laid off last week and I am searching for job.No one is offering job on H1B.I send a letter to coressman explaining my situation.
Can I use my EAD?-----My Lawyer says my EAD is invalid.
You may start looking for a job and as it is already 6 weeks past MTR filing, you may get a decision soon.
Working or not working on EAD is an ambigious call. Some lawyers say you can some say you cannot. If you already exhausted 6 years on h1b and if there is such a rule then your h1b is also considered in the same way as your EAD?

Has anyone thought of the people who missed the august 17 deadline because the labor was not cleared within time. Because of no mistake from ourside, we have to suffer. What a screwed up legal situation ?
As of now PD is apr 2001, I dont know when will it move ?

I don't think you should leave IV just because your 485 is approved and you are going to get the Green Card soon. IV has done lot for us and we should be supporting IV as long as we can.

don't you think they will face problems in 140 if their education doesn't match that in labour... its not as easy as you told..

You are right, they will face problems in 140 and they do.But you know what, thats why we have lawyers & education eval agencies , if you pay them they can make any degree or exp look like , anything else.
I know a guy who had BSC & got a sub labour , he had got many RFEs in his 140 , I don't know what happend in the end , but what I feel is, some of them can still trick the system.

It is very simple. The completion of degree occurs only when any one passes all qualifying examinations. Without passing the sublimental exam, you are not qualifed to recive a degree. You latest exam was in 2002. Therefore you completed all qualifying exam only in 2002. Therefore you obtained the degree only in 2002.
Therefore you must produce the 5 year exp certificate after 2002. If not, convert it to EB3.
At this time the best option is request them to convert to EB3. Apply another PERM LC with EB3 and file 140 quickly, in case they deny your request to convert to EB3. Dont give up your H1 and H4 status till 140 get resolved.

We as a community have not even done 5 % of the hard work that DREAM act advocates have done. So such provisions are well deserved by them for the hard work they have done. If we had done enough work for our provisions, there is no doubt our provisions would have seen the day. You need to do some search on all the DREAM act advocates have done in the last few years to reach where they are now. And then compare it our community effort and you will get the answers.
We recently had an advocacy day. How many of you contributed to it. We failed to even reach a modest budget goal for such a big event. So there is no point blaming undocumented. We need to first blame ourselves for doing nothing.
Only 200 ppl contributed and now 20 new memebers from July 2007 show up everyday in the prediction thread wanting to be current.

And this willwin guy has the nerve to give me a red mark on my post saying I'm not being diplomatic... like I care about being diplomatic when they want IV to shift its primary focus in order to cater to such ridiculous asks!! The service request is usually a waste of time. They will send a generic response to everyone when case is pending w/o visa numbers. I and almost all of my friends received a response that additional information was needed for processing your case and hence additional delay blah blah.. I think this guy just decided to use security message for your responses. I wouldn't worry about it. If you want to really check this, you can definitely make an appointment at local office and talk to the IO there. But it was even a bigger waste of time in my case. The IO at local office looked at his system/systems and told me that if it is a green card application its faster(just another month or so) and if it is a h visa there is a few month delay:confused: Go figure..

NY consulate is not the greatest but compared to Houston, it is fantastic. Recently I sent my papers for PIO to NY and they took their time but i did get it in 4 weeks time (their website says 2 weeks). I had to make multiple phone calls and if i used the automated system, it would take me to a phone that no one ever answered. If i went through the operator I was invariably forwarded to a wrong department or was told there is no one in the PIO department on that day!! But eventually, I did manage to reach the right person, who told me when to expect the passport and it did arrive in due course. I did send them multiple emails as mentioned at their web page that promised faster responses but till now I have not received any reply till date!
My friend had to send her papers to the consulate in Houston and it is absolutely horrible. Firstly, no one ever answers the phone at any of the listed numbers. An automated response asks you to wait in line and then after an extended duration, you are bumped back to the start of the line. No one replies to emails. Then they send back your passport on flimsy grounds without giving proper reasons. When you send it back, they find a new reason to send it back as my friend had to endure. Eventually, she had to find an 'agent' who charged her $1100 to get her PIO card which he did within a day. When asked to give the breakup of the costs, he said he has to bribe people in the consulate to get the job done.
So this in essence is the real reason why no one answers the phone in Houston or people are given the run about ..corruption. They want you to use the services of these agents who in turn bribe them and get the work done.

This basicalkly means that too many cases are stuck in name check at I 140 and I 485 stage or that USCIS is not processing as fast as it ought to.
To give you an ex I have a friend with PD of Dec 1998 (original case not substitution) whose I 485 is stuck in name check., My friend is not a Muslim. There could be many others too.
What does this mean? That there are not as many approved labor cases as anticipated originally by the USCIS????

EAD, AP & FP notice are sent directly to the applicant. If you see the status of AP as document mailed then you should get within 2/3 days as they send by DHL. I got mine in 2 days, my wife also got in 2 days

sometimes people give irrelevant advice. one guy asks im getting divorced, what shud i do with respect to 485? if people tell him, stop worrying bout 485, focus on ur life and fix ur marraige, then its not helping him from a "forum" perspective.
