this pit, the nature of this issue cannot be understood
b. A lot of people do not want to handle the truth and reality
c. Perception - without looking at the real picture, lot of people
assume things are fine
(3) Why should I take these issues seriously, my lawyer will take care
of these?
a. Immigration lawyers assist and handle the paperwork, this mess is
beyond their control or scope or even the scope of USCIS and related
government agencies
b. Immigration lawyers are your service providers and you are their
client, they will talk only business to you, there is no need for them
to explain to you the mess you are in
(4) After the July visa bulletin fiasco, I did submit my 485 petition,
and I will get an EAD/AP so why must I bother?
a. EAD/AP were designed to be interim benefits (only for few months
until someone can get a Green Card), their usage has limitations and
will lead to further issues
b. Severe retrogression will hit in coming fiscal years. India, China,
Mexico, Philippines, Eb3, and eb2, and ROW eb3 will all be affected,
c. Anti immigration lobby is targeting H1b tech workers, at the same
time a lot of lobbying organizations are working hard to make the
system unworkable for e.g.. Durbin Grassley amendments may appear
anytime
d. Until you get a Green Card in Hand, EAD is not the best viable
alternative for work and AP is definitely not the best travel
document.

Hi Summitpointe,
I think you can take info pass appointment and show them EB2 approved I-140 with priority date as Spt 2004. Last year I also converted my EB3 to EB2 but my lawyer filed I-140 and I-485 concurrently around Aug 2010 and USCIS rejected the application saying priority date is not current for the first time. My lawyer filed is second time with old fees stating that when application originally filed with old fees they again rejected and finally 3rd time with new fees they did accepted applications. For my case they approved my EB2 I-140 and 485 just same day....... and got my n my spouse's green cards... after painful immigration journey....

I have been continuously requesting in my previous postings that CORE Team should take up the issue of sufferings of children who have turned 21 and who could not file 485 applications due to visa retrogression. I do appreciate that this may not impact a large number of our members and CORE is committing its recourses for a much wider issue of over all visa number increase. However, getting visa number increased is a big effort and in current environment may not be achieved. However, getting CSPA amended may not e that much a big deal and if CORE team starts working on it, we may see positive result. As such, I again request CORE team members to take up this issue. I am prepared to lend my support in whatever way I can and I am sure there would be many other members who will be willing to do the same.

Folks, as a FYI, don't get too bogged down with all the details. Here is my status.
Applied on 3rd march for name correction/reissue of fresh passport.
1) Got a money order for $60
2) Filled out the online form
3) Took copies of relevant pages from passport, license, utility bill.
4) Signed each copy attesting that it is a true copy
5) Took a photo from my digital camera, cropped it on epassport.com and got 8 copies for 20 c. It is true that their scanner blurs the quality of picture, so better have a white background.
6) A couple of email exchanges. This is the best form of communication and I recommend being courteous. Be prepared for vague and sometimes obvious answers.
7) Received new passport on 30th March, although their website says 7 working days.

As MurthyBulletin and MurthyDotCom readers may be aware, April 30, 2001 was the deadline to file for INA Section 245(i) eligibility under the Legal Immigration and Family Equity Act (LIFE Act) of December 2000. This provision allows individuals who are out-of-status or who entered the U.S. without being inspected at a designated INS port of entry to adjust to permanent residence, if they are otherwise qualified. In order to benefit from this provision, the individual must be the beneficiary of a labor certification or a family petition filed on or before April 30, 2001. For this reason, extraordinary numbers of cases were filed nationwide on or slightly before April 30, 2001. According to the information released by the Maryland DLLR and other states, local DOL offices did not receive additional funding in connection with the LIFE Act filings.
With respect to case processing, the DLLR reports that they are processing RIR cases received April 5, 2001 and non-RIR cases received March 8, 2001. Of course, these processing dates will be further affected by the glut of cases filed on or immediately before the LIFE Act deadline.
These time frames are similar to those experienced in most other states that are attempting to catch up on the huge volume of cases filed on or before April 30, 2001. We will share information with our MurthyBulletin and MurthyDotCom readers as and when released by other state labor agencies.

Great Idea. Since this is Saralayar brain child, let us all nominate him/her to lead this venture , while us IV followers pursue more servile task's like trying to recapture visa numbers, get multi year EAD's and basically save our B*^$'s.
If this venture is a success Saralayar will be a citizen in a year (along with a few side kicks that are backing this new citizenship concept) or so and then he/she can push congress to pass the other minor legislation that will bail the rest of us out.

If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . When I see EB3-China data in USCIS's work sheet I am getting shocked. How come EB3-China has a such a low pending number particularly comparing with Eb3-India?

Your RD cannot be mid September. That must be your Notice Date. I bet your RD (the date CIS received your app) is either July or August.

In 2009, I went for a personal interview with an immigration Officer at local USCIS Office. She verified all the records and when I was about to leave, she gave me a form and said:
"When your priority date become current, I need you to send this form to us ASAP so we can check the visa availability for you. We personally won't remember your file and priority date."
The form contains my A number, my name, case status and is written "Pending for visa availability."
However, at this time, my files are no longer with local USCIS office. They have been moved to Texas.
So, when my dates become current, I will open SR or whatever to let them know that I am ready for some greenery in my backyard. :)
I am seeing several people contacting Congressman and opening service requests. These guys seem to have become current just this month and they do not have any patience. It is crazy in my opinion. As pointed out earlier there is lot of herd mentality on the forums and if one person posts, everyone else does the same. Some people I have seen on the forum call customer service every day to get case status. I urge people to read and try to understand the process than blindly following what others are doing. Secondly as posted earlier, tracking is also useless and a waste of time. It will not help you get your green card any faster. Have some patience and follow the process. Starting a service request as soon as your date gets current, cannot help you.

Hi, Did somebody take advantage of the new rule of H1-H4 decoupling where one can use the time spent in H4 in H1? or can somebody confirm that this rule is in place and a law ? Please let me know.
my wife worked for 31/2 years on H1/L1 before changing status to H4. After 4 years on H4, she recently got a job and he H1 was approved in 2 days under premium processing. So the decoupling rule is effective.

Ok I apply for I-485 and EAD.because the Visa numbers are current for my date..USICS takes my application in November for processing and my Visa number are then regtrogressed...then they will not process my GC right??..untill the number becomes current again...so I will have to wait on my EAD....???.

Both Addresses will be printed on the passport. One for current address in USA and other for Indian Permanent address.
Application form is asking for address to be printed and other address. I am planning to keep my India address (my place) on my passport. I use my passport as a address proof in Inida. It means i need to fill it in address to be printed coulum.

So most probably it was part of politics. Also this status says both these amendments wer eintroduced in Senate but thats it, they did not pass.

2) Within 2 wks no response, on 90th day I will walk into the local office (SFO) and ask for interim EAD.
3) If Still create the issues, packe the bags and go back to home country. It is really bad,
getting frustrating for everything no regulare process and always waiting.
