Your RD cannot be mid September. That must be your Notice Date. I bet your RD (the date CIS received your app) is either July or August.

I sent my passport with all the documents and $40 FEE + $20 EXPRESS MAIL to houston, TX
but they sent me my passport back to me, after 1 month but it wasnt renewed. They said that I have filled the wrong application but I can't find any other application that relates to my passport on their website.
MY passport was issued in INDIA for 5 yrs validity and I didn't know it was expired a year back so they also asked me notarise my application. they also said that you have not sent correct fee.
Please anyone can help me out here about which application should I send to renew my 5 yrs passport and how much is the FEE and all other necessary documents......

SFO took exactly 5 business days, incl. the day they received and the day they dispatched.

PERM approved in EB2 today after 4.5 months...now I'm officially EB2 and in the long wait line. Glad that my PERM got approved.

I recently received my GC and if I need to contribute and bring ppl who will contribute. let me know. We need to look at the long term picture. I waited 10 years to get GC, and now another 5 all this time pay taxes doesnt seem fair.
give me concrete agenda. I am not for amnesty and those illegals are holding our agenda hostage. We need to only focus on piece meal legislation for legal immigrants.

one another suggestion I have to make is this:
We need to get Indian/Chinese community (citizens) involved to fight for us.
We need to have some of them as leaders in the IV. (they could be people who have struggled with the EB process and identify with us) they could be highly successful Indian/chinese or other countries businessmen/scientists/media personal etc etc (if possible)
Remember the strength of the ilegal community is that their legal brothers and sisters dont hate them but always stand with them.
We somehow ( I have no clue how) need to get this to happen. Also each one of us who are currently here should make a pledge that "Even if my card is printed, I will continue to use the extra freedom that I got to always stand up and fight for my brothers and sisters who are struggling with this system".

I have a slightly complicated situation. All your suggestions are welcome.
I am on H1B with 485 filed. My wife is on H4, without 485 filed. My H1B and her H4 expires around end of March. She has an approved 797 (she will either need to apply COS or go out and enter on H1B visa) and her employer will begin her H1B proceedings hopefully before end of January.
I am thinking of applying for my H1 extension next week, without applying for her H4 extension at this time. If, in the next few weeks her H1B COS is not filed, I am planning to then file her H4 renewal.
Do you see any problems with this approach? Do you have a better idea?

A lot can be achieved, if all members honestly contact and meet and talk with the staff of the lawmakers in their town.
The problem with the EB Community/ IV members is that we think that going and talking with our lawmakers is not going to help. Or, we are under the impression that all politicians generally know everything about us and are just unwilling to do anything about it for political reasons.
The truth is that 90% of lawmakers and their staff have no clue that there are thousands backlogged and stuck in this process for a decade.
It is our job to educate, bring our issues to light and keep pressure on them to bring/cosponsor or vote for a meaningful bill that will allievate our problems.
When I visited my local congresswoman's office the first time in 2007- The staff was actually shocked to hear that I have done all the right paperwork and being employed and stuck for 5 years.
Over the years, I have met them many times and educated them about the issues and build a relationship. And yet, many times the staff wonders if there are really thousands of people like me affected, how is it that there is just me that is visiting them and talking about it.
Remember there are 435 house representatives and 100 senators. Each one of you are within driving distance (40 minutes) to a office of a rep.

Many lawmakers are not aware of the problems with high skilled legal immigrants. It happened with my Rep. To them, fixing immigration means - doing something about illegal immigrants - whether it is to send them back or to give them a path to gc/citizenship.
They asked me about how many legal high skilled immigrants are stuck in the state, and why is it that they are not voicing their concerns. As I did not have the statistics of how many legal hs immigrants were in the state, I told them that they were in a better position to get the information from the USCIS than I was. They nodded, and I have met with them many more times after that, and I ask if they have the statistic - they are yet to seek it from the USCIS. Its just me and my spouse visiting this office, so there is no urgency, or need for them to push themselves to find or act on it.......
Unless, there is united messaging throughout the country, our voices will only be feeble and gets drowned out by others who are speaking loud.
I started a thread about making meeting with lawmakers a priority this year, just a couple posted about meeting. That shows where we are in terms of advocating for the changes that will benefit us........

I have received messages from people who have been here around 10 years without a GC. I wonder how common this is. What do you think about proposing a "fast track" for people who have been here legally for more than a certain amount of time?

My suggestion is: those who have maxed out their 6 yrs on H-1B + have atleast crossed the labor and I-140 stage; should be automatically granted the green card.
These are the people who are really stuck, because if their green card does not get approved, they have no option but to return. Also, if they lose their job they are out of options as they cannot seek another H1B extension or transfer.
Typically, these people would have young children who were born here, and go to school here. These children sing the US national anthem and pledge allegience to the flag everyday at their school. Making these people wait and wait for their green cards helps no one. They are not taking anyones jobs, they are educated, civilized people. They have proved their usefulness to their companies and the society over the past 7~8 years.

Your wife should be good to stay with your change of employer upto the date mentioned in her current I-94.
I have been in your stage. I changed my employer last year. I asked same question to my attorney from my wife. Attorney said that there is no need to apply for another H4 because of mine change of the employer.
We went this year to india there was no issue to get the new visa stamped on our passport.
Note: I am not an attorney and sharing my experience with you. Please take a legal advice from attorney.

I understand that. However, apart from canvassing the support for CIR by writing to senators, lawmakers, in what capacity can IV influence USCIS to take up EB-3 cause?
Even if IV has intentions to ameliorate our pain, is it truly capable to influence the agency to do something for only one specific category ? At a micro-level, we EB-3 need to do something about changing our situation ourselves, lest we stand in the filthy excreta for eons. :mad:

I am on OPT expiring soon.. My employer filed for H1 and got approved for oct 1st. I will be out of status for sometime so I plan to go on H4( I am married) . Now one lawyer told me that If I apply for H4 my H1 approval will become invalid and I will have to reapply for H1. i.e if I do not have I 94 attached to the approval ( however I just got approval notification . no documents received yet , so no way to know if i have I 94 attached) Another Lawyer said thats not the case. He said I can go on H4 with a validity till

I got my passport renewed from Houston in 12 working days. I had sent my passport on 12/11/07 ,which has reached to houston 12/12/07 11 AM. I got my paasport renewed by fedex on 12/27/07. What a service . I guess there are working better now

Like I said you can start at the same pace as you normally walk from your car to your office. Do that for 20 mins or 30 minutes this week and we will increase the pace very slowly and add a few minutes each day. Also always listen to your body and do what your body can. it is very important to respect our body's limitations. I have learnt that the hard way

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.
I mean even if some of guys had their PD current, USCIS did not approve the I-485. They said that all the I-485's are preadjudicated but did we see flood of approvals....? NO... To say that 40000 visas will be wasted is wrong. I bet there are 40000 Employment based 485's pending at USCIS right now with PD's before 2005. So why not make PD 2005? This is just a stunt by USCIS to get as many I-485 applications and get money from EAD and AP for 4-5 years... Thats my thought...! Any buyers!!!
