Thanks nrk. I am keeping my fingers crossed. I was current for two months in 2008 but did not get. So hoping for the best this time but again I would not be surprised if I don't get it, especially looking at USCIS/DOS works.

I think they had given a waiver till August 21 or so for the July fiasco filers.
Do you think I still not have to pay or should I pay the fee ?

I recommend you talk to some lawyer or call USCIS.

My take on it is this : you have to PAY $340.
A lawyer will always say "DO AS PER INSTRUCTIONS".
But this case although unique, you still belonged to the pre-aug filers, even though there was a waiver (since u were applying based on PD which was for july month).
I remember that during that time USCIS has instructed everyone to add some kind of bright color sheet / paper on top of your application to state clearly that you belong to that group of pre-aug filing people and that you are filing using the old fee structure. that way you are clearly telling them "dont reject me directly because of incorrect fees".
Again although this seems very straightforward to me, that you HAVE TO pay $340, I still recommend you research more/talk to lawyer/USCIS.

Guys - Most of the banks have notifications service.Once u login to u'r account you can provide the cheque no.and request to be notified by e-mail once the check is cleared.. That way u don'thv. to check u'r bank a/c a million times in a day... :)

NK2006 thanks for the post my family and I recently entered US using AP and fortunately we were not questioned at POE. I am in similar situation waiting for 485 and filed AC21 when I changed jobs after six months.
That is not to say that we will not have problem in future. You mention your wife showed them a copy of rules pertaining to AC21. Can you post a link or post them here.
My lawyer never advised me to carry any such documents.

Dr. Emilio Gonzalez responded to such flower campaign in the USCIS site. Looks like you are using online degree to support your case as well, that is why you are so pissed off. No matter how loud you shout or how many people you threaten about lawsuits and all that stuff, no one can deny the fact that an online degree does not have much of recognition.
Say in clear and simple words -- are online degrees from University of North Dakota, University of Massachusetts, North Eastern University etc. legit ? Yes or No
Your beating around the bush and twisting words just show you have no argument. Didn't your MBA teach you that there is something called logical argument? Or was your degree from the like of TVU ?
It is only YOU who think that online degree does not have recognition . If you are yet to understand the power of Online educatoin you are probably living in stone age.
BTW, I do not have a online degree (though I plan to go for an online MBA) but I am pissed off when I see some so called educated people are so eager to get a GC that they will probably kill others to make their way.

Would you please elaborate if the flower campaign has hit any mainstream media like CNN, Fox etc?? Or just the TOI and other small covers? I just want to know how famous this has become.. Thanks.
Mainstream media seem to be cautious about these issues as it may work against their self interests.

gc101, if you are not able to get married before you you file your I485 (by Aug 17th).
One of my friend asked Shiela Murthy and she said that in order to be able to add my spouse , I would have HAD to get married before July 31st (which I couldn't anyway), because, then, only I/we will be eligible to add my spouse.
Also, I sent in the papers for my I-485 last night. Now, hoping to god that there is an RFE on this and some kind of delay.

I am a July - 2007 filer and we got the FP request in July for me and my Spouse, I have not applied for any EAD or AP extensions recentlly, for a side note i have to travel out side US in July and my attorney requested for FP reschedule (which was actually scheduled in last week July) for atleast 6 to 8 weeks, but USCIS sent me the request with in a week with an FP date just 3 weeks apart from the original one..so i had to rush my things and had to come back to US to get the FP done..
I just called TSC and got a helpful IO. He explained me that the FPs for my case are expired as those were done in Nov 2007. He issued a request to send another FP notice, not sure what help it will do at this time. He did tell me that my case is preadjudicated but also mentioned that preadjudication means nothing more than that a legal clerk or junior IO has reviewed the file and everything is order, in other words according to him preadjudication does not mean approval without any review.
