    Your logic is not right. They are still American companies as they are based and incorporated in the US. Number of employees in India does not matter. It would be different if they had a majority of Indian employees in the US...

    It is very clear that USCIS is yet to complete the receipt of all I-485 applications and are not in a position to give any statistics to DOL. I think then they will be busy in issuing AP / EAD based on the receipt. Considering the current work load, I think it will take at least couple of months for the USCIS to give any reasonable estimate to DOL regarding the actual demand. Till that time, I think DOL will be forced to publish the same status every month. :(

    I wish USCIS can use the people worked in Backlog Elimination centers to issue EAD / AP and clear I-485 receipts and provide some meaningful figures to DOL. [I hope they do not create another July bulletin fiasco :D]

    One small correction,it is DOS instead of DOL.

    Can I continue to work in USA, as i have valid petition till March 2013, even though my labor has been rejected . Please advise. Appreciate your help.

    Just received Card production e-mail for me and wife. Had pretty tough time last few weeks thinking what could have gone wrong as my PD is MAY 15 with everything clear. After waiting a while, 3/4 days ago I had infopass and went to Congressman for help.

    Though we are happy but can feel how tough it is to wait and wait....but I assure you all will get it soon, but take action as your intution says as you KNOW YOUR CASE BETTER THAN OTHERS. So take help if you think there is no question of RFE or delay is longer than ususal. Thank you IV and all members. I will contribute, as many of you did after getting it, and stay in touch with forums for anything I can be of assistance.

    I received an email today from USCIS requesting additional information on my case. My wife received identical email like I did.

    Please let me know
    1. How many days does it take for USCIS to send the letter.
    2. How many days does it take for USCIS to look into my case again once I send the evidence requested.

    Did anyone receive similar evidence requests. What evidence do they possibly need in this phase....

    Agreed. Changing the spillover rule is the easiest in this bad economy.

    How about we propose to USCIS/DOS to give spillover based on PD and not based on Category. This way EB3-I and EB2-I will move forward steadily without any fuss. I know initially it will help most of EB3-I but once EB3-I catches up with EB2-I then both can move forward together.

    Just a thought. I am sure EB2-I will give me lots of reds but I don't care.

    Well, we have to do something. Everybody got ideas but who is working on them? I am ready to send as many letters if needed but I need some help composing that letter bcoz I am not good at writing. Can somebody come forward for that?

    Use spill over visa to give GC based on PD not on country specific. It will solve the backlog in 2 uears. Right now EB2 I and C getting spill over from EB1 as well from EB2 ROW.

    This is not fair for EB3.

    I opened a Service request for my case and got a reply last night, saying 'you cases is assigned an IO offices. Please allow us 60 days to make a decision ....'

    I called the number on your I797 form and rep asked me, if I had any activity on my case in last 60 days. I said No so she opened a SR.

    You might want to add some important words there. Otherwise you will be at the tail of 12 million people queue and god knows how long would that take them to clear.

    There are a big disadvantage for them.
    - They will not be able to milk us of those dollars on EAD/AP renewals year after year

    Just 2 simple things...

    1, Green card to anyone who has been "legally" employed in the US for 5 Consecutive years( can provide W2 for the past 5 years)
    2, Citizenship for someone who has been in the US "legally" for 10 years.

    1.1, Once this provision kicks in normal approval within a specific time frame. say 6/12 months.
    1.2, They can also tie the 5 GC years with some minimum salary/prevailing age with region of employment.

    Advantages to us..
    - Removes all the stuff to do with country impartiality.
    - Makes us independent of employer.
    - Makes us competitive.

    Advantages for them..
    - Simple
    - Provides proof that the individual has been productive to the economy/country in the past.
    - They may wanna tie Citizenship with the 40 Credits from Social Security or something if that helps.
    - Removes loopholes which assists in driving down wages as employee would like to make sure he is employed enough to meet the prevailing wage for the year. (Drive the complain that we bring down rates etc)

    There might be more advantages, but I just wrote down a few.

    Hi,

    My Husband and daughter appeared for the interview on Dec 6th 2006 but they were given 221(g) blue form and were asked to drop the papers in Hyderabad VFS office and it was clearly mentioned not to attend personally

    As per The 221(g) form , they dropped passports and my original I797,I129 and all supporting documents including my original H1 papers and marriage certificates on Feb 20th 2007 , After 4 months on July 3rd 2007 we got a mail from ChennaiAF@state.gov to appear for interview on any Monday before 9 am with Passports and all other supporting documents but we have already dropped all the documents including passports in Hyderabad VFS drop box and it have been couriered to Chennai US Consulate through them.

    I mailed to US consulate to suggest whether they can appear for the interview only with this mail printout but I haven’t got any reply and also my husband talked to customer representative they said he can come with the mail print out as they already dropped their passports . My husband and daughter reappeared for the to US Consulate Yesterday July 23rd 2007.The security people didn’t allow him inside since they don’t have their passports my husband showed his Identification card and printout of the mail from ChennaiAF@state.gov and they allowed my husband but not my daughter as she doesn’t have the mail or identification card. She is 4 yrs old and we already dropped her date of certificate and passports in drop box along with my Husband papers.

    Finally after a long conversation they were sent inside accompanied by an Indian officer. But when he explained his case to the Indian officers they said that they were not aware of the mail from ChennaiAF@state.gov and finally he was sent to interview and US consulate officer said that his case is still under process and they were sent back again

    They have dropped the passports and all supporting documents on Feb 20th 2007 and now its been more than 5 months but still they say that the case is still under process. Can any one please let me know why he was sent the below mail from ChennaiAF@state.gov to attend for interview when the case is still in process. How long still would it take for this Administrative process and when can i expect a reply from consulate.

    Along with the passports they have also dropped the few original documents of my I-797, I-129 ,LCA , our marriage certificate and my daughters date of birth certificate. Please let us know whether if there is any chance to verify that passprot and my original documents have been misplaced by US consulate

    If this kind of restriction is not done what will be best way to resolve H1b issue? If H1b increase is done and similar increase is not done on GC then also problem to all IV members(retrogession will continue). If there is cap then certainly it will be reached every year within April.
    If they restrict consulting then Most of the H1b persons will get permanent job. Because of less number of H1 most of them will get gc within 2 or 3 years. GC holders and US citizens will do consulting. System will adjust iteself within a few months

    What a poor logic. How would all H1s get permanent job if consulting is forbidden. Some probably would , but not all. (Not that it impacts me... just for argument sake).

    As some one mentioned what would you call what IBM Global services , Oracle and Deloitte doing ? Consulting !!!!

    :eek:I believe Indians want to enjoy life too much after coming to US, the only way to succeed is to work hard and with sincerity . Based on the observation i see very few Indians fully committing themselves to work. not sure why :confused:

    Give me a break!!!!. Dude you must be smoking dope. Do you really think Indians do not commit themselves to work and still get paid for their service to the company. Remember we live in a Capitalistic country and its a "Dog Eat Dog" world out here. No service, No Pay. If you are out of a project and are not put in a different project and is on bench, you will be shown the exit door. This is not a country like the Indian Govt. service sector where people enjoy their life with gauranteed income and pension.

    I'm not sure how you got this feeling, but let me try to explain some of the reasons about your thoughts.

    1.) People might be more smarter than you might think. What takes 10 Hrs to finish a job can be done in 2 Hrs if you have great skills and is highly Productive. Working hard does not always mean you slog your ass off ...This will be counter productive. Working harder means you might not be having enough skills to complete the job or you are not smart enough to complete the job within the assigned date.

    2.) There needs to be a balance between work and personal life. Do you really think people always need to care about work and no life after work?

    3.) GC Issues. People are still working within the limitations of the skill sets that have been detailed in ones LC. They worked such a long time within the same skill set, its very easy for someone to complete the Job within no time based on number of years worked on that skillset.

    4.) Even if someone wants to work harder, take additonal responsibilities and want to progress in their career, every one knows that they are constrained by the GC process which will discourage them to try and acheive them and no wonder we all are hooked to IV forums to make our lives better after having GC in hand.

    Hope this helps you better understand the situation and pls do not generalize your personal opinions.:eek:

    I had an infopass appointment today and that was big waste of time and i had to drive 4 hours(2 hrs each way) for this.
    They did not offer me any more information than the regular customer service.
    She told me that they have received my FP on 7/22 (although I have given mine on 6/19) and it is not unusual that my application is pending. She asked me wait for another 30 days and come back if I dont receive until then.
    I asked her if she could send an email or open an SR to the service center, and she said no saying that she will do that only after 30 days have passed beyond 90 day period.
    I asked her about the interim EAD and she did not understand what I was talking about. When I provided her about USCIS memo, she said "yeah that is what im saying, we will contact the service center for that 30days after the stipualated 90 days have passed". Basically she did not know what she was talking about.
    Im planning to contact the senator next week (this time I want to make sure that 90days have passed before I approach them)

    Interestingly she told me that many people are coming to her everyday regarding the same (EAD renewal) and that Service Centers are aware of this (although this does not make any difference to us).

    When I asked her if the case was assigned to an "officer", she told me that EADs are not assigned to officers (unlike 485) they are just reviewed and approved.

    Hopefully they will approve our eads soon so that I can atleast drive a car.

    Thank you everyone, who has been trying so hard to keep this thread alive, active and on track.

    I know we are nearing our self set deadline of Dec 31st to double our membership through the Add ONE Member campaign. The goal (15000 members) is no where in sight. But I am not worried. In fact, I am very much enthusiastic, because we were able to add a considerable number of members in the last week.

    But we can do a lot better!!!

    A IV update on another members only thread about opportunities in Jan and Feb, made me take time out from my very important work project and send this message out. We need to increase our membership NOW!

    And the Add ONE Member campaign is the perfect vehicle.

    Let each of us add one member. Also I suggest that one of us take the responsibility to PM online members and remind them to add ONE member (some of us just need a reminder).

    Also, Pappu or Logiclife said that they would attach the Add ONE member campaign details in the IV newsletter. I think we should send the newsletter immediately to all current IV members.

    Together we can achieve this very attainable goal of 15000 members by Dec 31st.

    I have requested to post your PERM details for the filed of work, TWICE now. Except for one, nobody responded. You guys are not telling about your filed of work. Looks like those who are in PERM trouble are from IT related filed ?

    I am trying to see what prompts these audits. EB2 or EB3 or It or combination of EB2/EB3 and IT or non IT.
