I am probably waiting for the longest here for EAD, my app received on July 2nd at NCS. Called numerous times, sent form 7001, emailed senators twice, 3 infopass appointments, still no progress. I submitted expedite request based on humanitarian grounds last week, have been calling daily to check status of expedite and still remains pending. My case now pending about 157 days. Anything more that I need to do ?

Practically speaking: EB2 I moves to 01 APR 2004
Optimistically speaking: EB2 I moves to 01 JUNE 2004

EB3 I:
EB3 I move forward by at least a quarter.

I am sure you are not just some reactive person who can only criticize but can also provide us with a solution.
Lets hear em.
This is easy, practical and may be more effective.
Co-ordinate working round-the-clock (24 hours non-stop) wherever, in whatever organization/immigation community is working.Let it be coast-to-coast. let the work start as usual on friday morning at 8am and end at 8.am on saturday. Employers will be happy and we can win enormous support. Send simultaneous cards to uscis/law makers.

I couldn't really find any information about the appeal process on the LC once it is denied. the ironic thing is that my first LC was approved then after I got promoted to a senior position and applied for a second LC, the 2nd LC was denied because they think there is no difference between the 1st and 2nd position. does the DOL have an automatic system that processes the LC and that why it coudn't see the difference between the 2 positions??

4-6 months that's what I heard from an attorney. The reason I am preparing 2nd filing is that the chance of approval of my first PERM on appeal is slim. Yes the initial reason for denial is bogus, but they may still deny it because of "too restrictive requirements"

The 3 year experience = 1 year education towards degree is used for H1 NOT for GC. It has never been for GC.
For EB3 GC, there is a classification for skilled workers which do not require a degree.
USCIS in eb3 used to allow the langauge "combination of educatoin and experience is acceptable to meet bachelors requriement" in eb3. This was before they broke out the different classification of professional and skilled worker in eb3. now they have broken it out separately on the form. If labor allows combination, then person is supposed to file as "skilled worker".

It is nice to see that the senior leadership is taking notice of the 'pain' some of us are going through right now.
Disclosure : I have already received 2 year EAD (thanks to IV). I have taken initiative to bootstrap the effort to help others who haven't been so fortunate. Since we are all in the same boat let us watch each others back for a change, instead of trying to backstab each other at every available opportunity.
This is NOT a yet another case tracker /EAD tracker thread. I don't believe that just tracking stuff will change anything. Be it EAD issue or any other, real world action is needed to solve it.
I have started this thread to guage the impact this issue has had on our community , how many members are affected, what actions have been taken by them, so that next steps can be taken. If a large number of members are impacted IV may decide to take up the issue.
Here are the options available to applicants
1) Call National Customer Service Center and create a Service Request (SR) to expedite the case
2) Fax and mail a letter to Service Center requesting to expedite the case due to possibility of job loss. Since the burden of proof is on the applicant - a letter from the company that EAD is necessary for continuation of job may help.
3) If steps 1 and 2 don't produce the results and CRs refuse to open SRs citing silly reasons, USCIS Ombudsman may be approached.

4) Approach your US Congressmen/women Representative/Senators. Every office has a different form for requesting Immigration help. They can open an inquiry with USCIS on your behalf.
Following the above (4) steps is no guarantee that your case will be resolved. But it is necessary that we follow all possible avenues before the issue needs to be escalated. We shouldn't feel embarassed at the question "Did you follow up with all these avenues available to you?". Our answer should be - "Yes. We did all that and it didn't help". And we should be able to produce the proof that we did do all the four steps mentioned above.
If you have done all the four or after you have exhausted all avenues, AND are willing to take it further - speak to the media, participate in possible IV campaign etc., post your details. We need members ready to go public with the issue if we want to succeed.
Right now, I have started this as an individual initiative. But I am sure that IV will get involved once it's proven that a large number are impacted and there are enough members to turn it into a campaign.

Yes, you are right....he did indeed use "passive resisitance" in South Africa. We all learned about it in school and I can remember the idea making a HUGE impact on me as a kid.

what you say above is true. but the fact is that we are what we are ..and we are at cross roads ..and that is where we are.
the main question is how do we increase membership .. the answer to that has to be in meaningful and visible campaigns.

Hi,
I am in the same boat my DL will expire on sept 30th. went to Hackensack/Lodi DMV. They extended till Jan 10th 08.
Best thing is do not depend on one DMV. try different places. in some DMVs the officers are not aware of our situation.

As per the state dept folks, pretty much all categories are using all their allocated numbers. So where is the spill over going to come from?
country quota will not impact I and C once the dates are current for ROW due to the spillover. If the number of applications pending is, say 100K and 95 K out of that are I and C. And assume 10K applications from ROW are add to the queue, what I am saying is all 110K will be cleared by end of the fiscal year.

Correct, there are problems with the online status with TSC.
My AP status say pending since 10/04/2007, I got my AP documents from attorney this afternoon.Still the status says pending.

Btw, I have a question about background/namecheck. I remember reading someplace (official) that fingerprints are valid for a period of 15 months. Now imagine this - at the end of that period, you are fingerprinted again, and while the background/namecheck is in progress the "annual lottery" period opens up in Jul/Aug/Sept. Is that file skipped again since background check is pending?
