YOu can surrender your GC letting know the USCICS that, it got approved when the PD was not current. I had read this on murthy.com. Browse the website to learn more about it or contact murthy.com attorney's.
How am I so sure...?? Even I am one amoung them praying for 485 not getting approved untill I get married. My PD is 2006, so I guess I don't have to worry too much.

seriously? you working in some gas station too? what other advantages have you taken of the system?
Sad to see students being punished like this. They are just taking advantage of the system and make some money, but not doing anything illegal. That's what we are all here for right? Make some money. If enrolling for F1 and working somewhere else is against rules, then why did USCIS issue F1 and CPT to the students.

Are you sure he is not going to mess up ur case because u filed using a different law firm against his wishes.
You only can answer the above question. If u think there is a possibilty that he will mess it up, Dont go with a different law firm.
Talk to him and see what he needs.
I do have copy of labor approval but I donot have copy of job description that they filed for labor. I also have copy of 140 approval.
I don't think I can get letters from HR (there are couple of people who handles everything from getting timesheets to posting payslips) as they very loyal to my employer.
Then I guess my only options are
- give it a try to file through another attorney with paystubs and without employer letter.
- forget about $5000 and proceed.

Paper Filed EAD and AP Renewal for me and spouse on 7/1/08
NSC Receipt Date:7/2/08
EAD Approved:8/18 (There was no FP)
AP Approved:8/20
EAD Card Received: 8/23 with 2 years validity from date of issue(not from date of 1st EAD expiry) .Lost only 1 month though.

A difficult option though since ur marriage is already scheduled...
Maybe she can apply for F-1 visa first, then get married...Let her come to US on F-1 and then get married here in local county...But it's tedious and lengthy process though, apart from the heartburn ur gonna give to many back home by postponing ur already fixed marriage...
Best way to deal with the situation is talk to an immigration lawyer...

Guys I beg all of you to who have not voted to please vote. It might seem irrelevant or not useful to vote but even small things like these add up. We have threads like spelling bee going into multiple pages but not threads relevant and useful to us. Please vote not just for this but also have an open mind and participate in all activites. There is a thread where you can send a letter to whitehouse explaining our misery and asking for removal of country quota and visa recaprure, how many of you have sent the letter. Please do that .

Application Type: I131, APPLICATION FOR USCIS TRAVEL DOCUMENT
Current Status: Document mailed to applicant.
On November 7, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service
I received my AP on Nov 3 and looking at the AP doc it had an approval date of Oct 10 whereas I had "Document mailed to applicant" message on Oct 31.
I am not sure what happened between Oct 10 and Oct 31st.

Let me put it in an other way..
If you graduated from an IIT or IIM the chance that you are here in the US is 5-10%. Or in other words, 95% of those currently doing masters / PhDs in the US wouldn't be here if they were capable of securing admissions into an IIT / IIM.
Atleast for IITs pre 2000's 90-95% of the students are in the US. Even pre 1991, the first batches like 1969-1985 etc have like 1-2% people in India. The trend has changed only recently, even then it is more like 40-50% students after IIT/IIM end up here (if not immediately, after like 4-5 years).
But it is true of the people in MS/PhD in US, 95% are not IIT/IIMs as there are not so many people that graduate from these schools.

I firmly believe that you should not let go this company who screwed u....first and foremost hire a good immigration lawyer (i know it will cost some $$$)....but its important...and discuss with him your case...then sue that bastard company and let him have sleepless nights for couple of months....
Its fraud for the company to accept money for filin 140/labor....they will be screwed more for that...u can mention that the company told u that each employee pays his own costs....and hence u gave him money
