there should be a cap on how many H1's a MNC that's not based in US can apply. ex: companies(like wipro, infosys, satyam..)
for ex: it should be <= 300 per company.
These people consume lot of H1's when they could get their employee's on L1.

And one way to try to manage this is by country limits.

What is the procedure to file Tax from India?
1. Designate one of the tax filing companies (HR block etc ...) as your agent by filling a form (check IRS web site) and give it to your. Your company will issue W-2 to this agent. You have to pay filing fee in advance to the tax filing company.
2. If your company issues W-2 electronically and your banks/financial institutions produce 1099s electronically, you can file the returns from India electronically and direct refund to your bank account.

This is what I got from 4 separate lawyers when I was invoking AC-21. I think everybody should speak to a lawyer before invoking AC-21.
A lot of people out there think that after getting EAD one can invoke AC-21 to change to any job at any employer. This is not true. AC-21 is pretty complicated and I think that in the future, if there is no change in the law, a lot of 485 applications will be pending for 6-8 years or more. And for the duration of this period, a lot of people will invoke AC-21. I also think that the rate for rejection for number of AC-21 cases at USCIS will be higher. Nobody told me about the approximate wait time and rejection rate. It is just what I think based upon the developing situation.

Is your GC approved? Which stage are u in.

Good question. I am in the same situation. My GG was approved Aug 6th and happen to attend an interview the same day.
I already used AC21 and may have used it second time for this if GC was not approved. So question is can you switch jobs within day of receiving CG ?
From forum search, it does seem ok to switch jobs. Its hard for me to find a valid reason on why we need to stick to the employer for 6 months or 1 yr.
There are cautious people (to say it right, paranoid people to put it blunt) who will not use AC21 or have the theory of sticking to employer for 6 months or 1 yr.
I am still pondering, but leaning strongly towards switching job if the offer is good.

What makes you think they are processing EB2-I more? Same logic applies here. Wait for the next bulletin, if you are EB3-I in 02 you'll get what is long overdue?

It seems as per current DOS practice, the answer is yes. They will be issuing only 2800 EB2 visas per year to India and China. They will be issuing remaining unused visas by EB2-ROW to EB3-ROW.
So that means the unused Visa number flow "downwords" within the country category NOT "accross" the EB category.

I got LUDs on 2/10 on both mine and my wife's 485. My wife got an RFE email on 02/13. I do not know what this means either...
Looks like lot of EB-3 applications who filed 485 at the end of june got LUDs last week, some with RFE and some just soft LUD.

I would be delighted since I am from EB3-I. That is what is unfair about this country cap. You probably filed your GC in 2009 and is already impatient. Think about people who came to this country in 2000 or before still waiting for their GCs.
Some of them has aging out kids who will lose their eligibility because of this long wait.

USCIS will not look into your tax records for H1b approval. They might ask you for your previous H1b approval notices and or pay stubs but thats all. However when you go to the embassy for the stamping they might ask for tax returns.
